Russet Noon aka rip-off?

I came across this little number today from Twilight Treasury, who had gotten this information from Buzznet. Frankly, I am quite put off, outraged, and disgusted that someone would use characters created from another author (Stephenie Meyer in this case) and create their own story from it. To me, it seems as though this is a violation of some sort; all I know is that I won't be reading this garbage, as should everyone else out there. Buzznet has reported the following:
"Come September 2009, a new volume in the Twilight saga will hit bookstore shelves. It's called Russet Noon and picks up where Eclipse leaves off—except the story is told from Jacob Black's perspective. Oh, one more thing... The book isn't written by Twilight author Stephenie Meyer . Instead, self-proclaimed "gothic webmistress" LadySybilla takes a stab at the series. Confused yet? Us too."

Okay, so Buzznet just said this book begins where Eclipse left off. It seems to me that they meant to say where Breaking Dawn left off. Just an observation of mine. Buzznet continues:

"Although author Stephenie Meyer started writing a follow-up to Twilight (entitled Midnight Sun , which would be told from Edward Cullen's POV), she quickly shut down the possibility of the companion novel after an incomplete partial draft was leaked online . Meyer eventually made the pages public...but she insists that she's taking a break from Twilight duty "indefinitely." However, that doesn't mean that someone else can't come in and fill the void, right? Enter LadySybilla.

We don't know a whole lot about the author—an intial Google search for "LadySybilla" came back with nothing more than a weird YouTube channel attributed to her—but we have some sparse deets about the book's plot. According to PRLog.org :

The Volturi are now watching the Cullens even closer, and a conspiracy is brewing deep within the catacombs of of Volterra. Aro is determined to put an end to Bella's happily ever after. He is obsessed with getting Renesmee to join his clan in Italy, while Edward and Bella refuse to make Renesmee a full vampire. Renesmee hates herself for being only a half breed, and her unhappiness turns Bella against her own daughter. Humans in Forks are starting to suspect something about the Cullens, and Renesmee's lack of self-control is to blame for it. Bella and Edward might have to leave Forks permanently to protect Nessie. Meanwhile, the spirit warriors have returned to live among the Quileutes. Taha Aki has made contact with Jacob to warn him that great danger is coming to La Push."

So you get why I'm upset about this. This is totally bogus, how dare she! So isn't this copyright infringement at all? Here's the official statement from AV Paranormal, the publisher of Russet Noon :

"When fictional characters become such an intricate part of the popular psyche, as is the case with the Twilight Saga, legal boundaries become blurred, and copyright laws become increasingly difficult to define. This is especially the case when actual cities like Forks and Volterra are used as the novel's settings. Such settings are not copyrightable, as they are considered public domain. Similarly, the Quileute Nation is also not copyrightable, and neither are vampire or werewolf legends. Copyright laws protect writers from unauthorized reproductions of their work, but such reproductions only include verbatim copying. Characters are only copyrightable if their creator draws them or hires an artist to draw them. Stephenie Meyer herself borrowed a great deal from previous works dealing with these mythologies."

Yeah, whatever. Those characters belong to Stephenie Meyer, period. Sure, someone should be able to use actual places and anything not created by the author, but the characters are Stephenie's. This was her vision and now a very big part of her life. I'd really love comments from everyone regarding this. I want to hear your opinions, maybe they differ from my own, who knows. So, what do you think about all of this? And do you think Stephenie should take action again this so-called Lady Sybilla? I think it would be a complete disservice to Stephenie Meyer is anyone were to buy this person's books. She has no vision, no imagination, and I see her as a thief who has to steal another's ideas to try to make a name for herself. Shame on you Lady Sybilla!
Btw, there was the preface of Russet Noon on a youtube video that Lady Sybilla had put up herself. However, I noticed she'd removed both of her videos. Probably due to all the harrassment she's received about it. lol

I agree totally. How unfair to reap benefits from something you didn't create yourself. We should all do our best to keep people aware of scams like this. The Twilight Saga belongs to Stephanie Meyer and we all need to help her protect her creation even if it is not copyrightable.

WHAT!!!! This is outrageous I totally agree with you fine the idea of vampires and werewolf’s are out there but did someone come up with a Nessie before? That is so low to take someone’s characters like that, especially since she probably isn't a fan but someone seeing a get rich scheme. I think that Stephenie's agents need to go after this and shut it down. We could petition I am sure there are more than enough of us to petition the publisher and cause them to shut this down. She is even ripping off the book artwork theme. She can’t even be original enough for that.

I don't like this either. I agree that the characters are Stephenie's own, and shouldn't be duplicated.

However, I'm not so sure some fans won't buy the book. They are hungry for anything Twilight related, and if Stephenie isn't going to finish Midnight Sun or set a release date for her Twilight Companion book, then fans may go elsewhere for another fix of Edward and Bella.

So, to that end, I saw: Stephenie...we love you and need more Twilight!

Laura, I would sign that petition twice. Seriously. I can't believe people would do that. I read little stories people have written about Twilight, (one was written if Bella had stayed with Jacob and not with Edward) and I think that's fine, but trying to make money off of it? The writer should show her face (if she dares) and the publisher should have known from the get-go that this wasn't ethical. Until I hear an official statement from Stephenie that she doesn't mind, I'm going to be pissed. (Can I say pissed on here?...)

Lol, pissed is fine with me! :)

Well i have been a Twilighter a few months before the movie came out, i had read the 3 first books but did think much about it, the movie make the big explosion in me and i been hocked sense, i agreed with everyone, and specially with Artsy Fartsy when you don't have any more material to read you pick everything you found on the way, it's a total rip-off but and i found it very insulting to stephanie's book and the fans, the story doesn't sound that bad (except that part with Nessie self-control)and in my some cases when a different writer takes on a saga it gives a new kinda life to it... Again not justifying and very much obsessed about it, but lets wait to see what happen...

Okay, so is this person actually trying to sell this? Cause blurred lines or not, that's completely unethical!

I myself have been writing my own fan fiction sequel to Breaking Dawn, but that was just to fill the void that was left when I finished devouring all 4 books and the movie! It's for fun! And I even say on my website where it's posted that I don't own the characters, and they are Stephenie Meyers. And I'm certainly never going to make money off of it.

This chick should be ashamed of herself.

That is ridiculous! Really, that is fanfiction....which there are tons of on the web....but to publish one, stating that it is supposed to go along with SM's creation, is NOT okay. SM should have some legal rights here....surely she'll do something!

Anonymous said...

I completely agree with Artsy Fartsy, once you finish reading all SM's books you feel desperate for more Edward and Bella, so maybe the only way to block this woman is by finally publishing Midnight Sun at the same time and see which book sells more... want a guess??? Midnight Sun, of course.

I think SM should go ahead a finish Midnight Sun and the other 3 books from Edward's POV, it's so much wittier, it was great reading it, loved it!!!! Please Stephenie, finish it, we need it!

this is horrible! i completely agree. some people have written their own online versions for fun and that is totally okay with me, but someone out there trying to make money off of stephenie meyers characters and storylines? that is sooooo wrong! it shouldn't be allowed. if she were to just write a book about vampires, thats one thing, but to actually use characters from stephenie's books and continue stephenie's storyline for money is outrageous infringement on copyright laws. i will not buy the book.

and jia, your stuff is great. and i think writing for fun is awesome. a great way to fill the twilight void like you were saying. ain't nothin wrong with that. but this lady took it to a different level by trying to sell it! way wrong.

Anonymous said...

Ugh! how could someone do this?! Well all i know is that I'm not buying it and I hope no one else does either! Thats Stephenie's Saga some other author can't just add a book to it! Especially not with out Stephenie's permission!

Katie C. said...

I agree with Artsy Fartsy and Cris. It doesn't matter that this is wrong on so many levels. There are some fans out there that are dying for another book and because of that I think people will buy this book. SM should finish Midnight Sun and the rest of the books from Edwards point of view. I honestly think it is the only way to prevent something like this from happening.

Come on Stephenie, finish it! I loved being in Edwards head!!!

Untypically Jia said...

Thanks Holly! That means so much. I've gotten feedback from people who say great things about my fan fic, and I consider it a way to I dunno . . . honor SM!

I agree with everyone here. I hope she finishes Midnight Sun as well as the other three in Edward's POV. What I read of Midnight Sun on her site made Twilight so much better for me! It even made the movie better because I saw hidden motives behind certain things. I love it!

I don't know if I'll change POV in my fan fic, I'm not nearly as talented as SM to be able to switch like she can.

Anonymous said...

AMEN!!! I think her idea sounds dumb. I wont read it and I'll kick whoever does!

Who ever reads it should be ashamed and should be slaped several times for turning agensed stephenie.I agree with Artsy Fartsy lyk so many others have!!!

The publisher is letting people vote whether they should pull the plug on the project.

Jia, where do you write your fan fic? I would like to read it...

Anonymous said...

Is this a joke?? Russet Noon? It sounds like a Dr. Seuss rhyme: New Moon, Russet Noon... sad. As ridiculous as this is, I'm not surprised. Some people will do anything to benefit from others' success, and with Twilight it must be especially tempting since us fans are so rabid about the Twiverse. But PLEASE, pitting the Cullen family against each other? Bella vs Renesmee?? As if!! The stupid plot pisses me off the most!

Untypically Jia said...

I don't mean to advertise my fan fic here (but an Anonymous person asked me for the link so I had no other way of giving it.)

twilightcontinues.blogspot.com

Mine is called Edge of Night and is not written for profit! LOL! And the story doesn't pitch mother against daughter for anyone else interested. Just an homage so to speak to Stephenie Meyer for creating such beautiful characters and stories.

Also, I accept feedback (since I go Chapter to Chapter) so if readers don't like where I'm going I can change pace or add in things they liked from the books, etc.

LOL Shelly Song! Dr Suess' Twilight!

LadySybilla is going to get sued so fast she gets whiplash. I mean, she's using characters that aren't her own FOR A BOOK SHE PLANS TO SELL! WHAT THE HECK?

Okay, I needed to vent.

I think we all did Anonymous. It's so unethical. And disrespectful to SM herself.

Oh come on. Of course this isn't copyright infringement. Ever heard of the Star Wars saga? There are thousands of different Star Wars books on the market using the same characters George Lucas created. There's nothing wrong with this at all. In fact, it only serves to enrich the twilight experience.

Untypically Jia said...

There are lots of different copyrights and trademarks tho. I know that George Lucas had a hand in some of the books. Or he's at least given credit and paid rights for other publications. From what I've seen (personally) this doesn't look anything like that. Just my opinion.

Untypically Jia said...

I'm curious as to what Stephenie Meyer thinks. I hope that she'll post on her blog something in regards to this.

Anonymous said...

Thanks Jia. The anonymous who asked you for your fan fic link was me.
I have seen it starts after Breaking Dawn so I will wait until I read that one. I'll start with it in a minute after waiting 3 weeks for my copy (the longest wait ever, but got it finally this morning) so I bet it won't be long until I can read your stuff, lol.

I'm afraid you're wrong: this is clearly an infringement of Ms Meyer's copyright, and if this new writer continues with her plans to publish or distribute her book in any way, she's going to get sued half-way round the planet: the Twilight series is too big an earner for her publishers' lawyers to leave this one alone.

Fan fiction is often meant as a tribute of sorts, but it's still an infringement of copyright. There is no doubt of that. And just so you know, the various Star Wars books and products are all produced under licence and anyone who comes to light for infringing on those licences is in big, big trouble.

I blogged about this whole affair last week, if anyone's interested: you can read that here.

http://howpublishingreallyworks.blogspot.com/2009/03/train-wreck-now-boarding-on-platform.html

Please, to any of you who are writing fan fiction: by all means enjoy yourself with it. But don't convince yourselves that it's somehow OK to publish or distribute it. You could end up stuck hip-deep in a lawsuit, and that really wouldn't be nice.

There's a huge difference actually. You see each and every Star Wars books comes out under the Lucas Books imprint and it's copyright belongs to Lucasfilm. Meaning that the Star Books are official and authorizated.

But this Russet Noon book is/was sold without the permission of Stephenie Meyer and her publisher (Little Brown).
LadySybilla is basically putting up her own fan fiction for sale. Which is quite illegal and that's why people are calling attention to it.

hoLLy said...

I agree. "The Browns" don't seem to understand the way copyright works!

Anonymous said...

The Meyer camp and the US publishers are silent because ANY reaction from them will give Silly Potatohead exactly what she wants: official attention.

The fic writer is after sales from the morbidly curious and fans who want something new to read, however dismal it is compared to the originals. (I've seen the prologue and need eye bleach.)

She's trying to make money leaching off Ms. Meyers work, but more than that, she's getting attention and validation. What a sad and sorry excuse for a person.

Better believe that she's just dying to give an interview on CNN about this. I expect she's bought a special outfit for it and has rehearsed in front of a mirror her clever replies to questions.

Ain't gonna happen.

This is my thoughts on this...if SM wanted her fans to be happy and if she truly cared about us she would finish writing the twilight series..so what if someone on her team leaked the book..we didn't do it but we are the ones who are paying the price of their decietful deed!!!! This was bound to happen because of the way she(SM) acted she promised us the books that were told by Edward and is now acting like a child..so though it might be wrong someone is trying to fill the void left by SM on all of her fans and loyal readers. The one thing that sucks about the book this other person is writing is that it's not SM's vision!! I will not buy the book but at the same time I also will not buy any SM book and support her letting down the fans who made her career what it is today. How selfish of SM to do this to the ones who love twilight and her and supported her dream!!!
